1. ACCEPTANCE OF TERMS

By accessing and using the KELEVRA website (the „Site“), you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service. KELEVRA is not a corporate foundation or a standard non-profit; it is a journalistic project dedicated to radical transparency and the preservation of Western freedom.

2. LEGAL FOUNDATION & JURISDICTION

KELEVRA operates under the protection of international human rights and constitutional law. We explicitly invoke:

  • Council of Europe: Art. 10 ECHR (Freedom of Expression).
  • European Court of Human Rights: Established case law regarding media freedom and the protection of journalistic sources.
  • European Union: Art. 11 EU Charter of Fundamental Rights.
  • United States Doctrine: First Amendment (1791) – including the Brandenburg Test (Brandenburg v. Ohio).
  • Due Process: 5th & 14th Amendment of the U.S. Constitution.
  • Human Protection: Art. 2 ECHR (Right to Life) and Art. 3 ECHR (Prohibition of Torture and Inhuman Treatment).

3. THE RISK OF CRITICAL JOURNALISM

You acknowledge that critical journalism is a high-stakes endeavor. Truth-telling in the 21st century can be life-threatening. KELEVRA stands in the tradition of those who paid the ultimate price or faced extreme persecution for the freedom of information, including but not limited to:

  • The Fallen: Anna Politkovskaya, Jamal Khashoggi, Daphne Caruana Galizia.
  • The Persecuted: Julian Assange, Edward Snowden, Roman Protasevich, Reality Winner, Gao Yu, Can Dündar.
  • The Digital Pioneers: Markus Beckedahl & Andre Meister (Netzpolitik), Daniel Domscheit-Berg. By using this Site, you recognize that the dissemination of truth is a fundamental necessity for a free society, regardless of the personal or political risks involved.

4. DATA PROCESSING & PRIVACY (GDPR COMPLIANCE)

In accordance with Art. 6 GDPR, our legal basis for data processing is the Protection of Freedom of Expression and Information and our Legitimate Interest in operating a journalistic platform.

  • Retention: We do not store data longer than technically necessary for the operation of this Site. We do not engage in the commercial exploitation of user data.
  • Cookies: This Site is designed to be privacy-first. We do not use tracking cookies or ePrivacy-invasive technologies. If you don’t see a consent banner, it’s because we aren’t spying on you.

5. INTELLECTUAL PROPERTY & SUBMISSIONS

All content on KELEVRA is protected by international copyright laws. You are responsible for any submissions; unlawful or defamatory material that violates the safety of third parties will not be tolerated.

6. DONATIONS & REFUNDS

All donations are made in support of independent journalism. While we comply with international standards for charitable contributions, please note that donations are generally non-refundable unless specified in our Refund Policy.

7. INDEMNIFICATION & GOVERNING LAW

You agree to indemnify KELEVRA against any claims arising from your unauthorized use of the Site. These Terms are governed by the principles of international law, the ECHR, and the laws of the jurisdiction in which the core operation is registered, without regard to conflict of law principles.
